$100 Million Dollar Jury Verdict in Recent Transvaginal Mesh Trial

On May 28th, 2015 a 52 year old Delaware resident, Deborah Barba, who had claimed permanent injury resulting from a transvaginal mesh insert, received a $100 million dollar verdict from a Delaware State Court jury to be paid by Boston Scientific Corporation. This award included $75 million dollars in punitive damages as well as $25 million dollars in compensatory damages. The $100 million dollar award came at the end of a 2 week trial. The jury deliberated for a mere 7 hours before reaching their decision.

The plaintiff, Ms. Barba, was a former bank teller who was implanted with a Boston Scientific Corporation Pinnacle and Advantage Fit transvaginal mesh insert in 2009. This insert is used to treat pelvic and organ prolapse along with urinary incontinence caused by stress. Ms. Barba claimed that her inserts eroded after her surgery and scarred her vagina along with causing a great amount of additional health issues. She went through two surgeries in an attempt to remove the transvaginal mesh implants and correct the issues the implants caused but she was still left with a great deal of the mesh implant still inside her. After two failed surgeries she was left with chronic pain and an inability to have sex due to the severe pain it caused.

The Delaware jury came to the conclusion that the mesh devices implanted into Ms. Barba were in fact defectively designed and that the executives of Boston Scientific Corporation had committed fraud by concealing the true risks of the mesh from both doctors and patients. This is the largest verdict against Boston Scientific and far exceeds the 2014 Texas jury verdict of $73 million in a case that involved Boston Scientific’s Obtryx sling.

Although Boston Scientific Corporation was found non-liable in its first two trials involving transvaginal mesh implants, the Delaware jury verdict is now the 6th one against the company. This newest award comes mere weeks after Boston Scientific Corporation announced that it would pay nearly $120 million dollars to resolve nearly 3000 claims.
